This is a legal dissertation authored by City Attorney T. B. Cosgrove and is addressed to the Common Council of the City of San Diego. Cosgrove refers to Spanish, Mexican, and Californian land laws to make the case that San Diego is legally entitled to use the San Diego River as a water resource. Central to Cosgrove's argument is that Spanish and Mexican laws that applied to San Diego when it was a presidio and later a pueblo (town) still apply to it as a city. Spanish and Mexican laws had dictated that any body of water could be used by anyone so long as said individual did not jeopardize the water's availability to the entire community of the respective presidio or pueblo. Cosgrove elaborates that because San Diego would use the San Diego River as a water resource for communal purposes, it has legal protections to use the water from the river.. Book.
