An original document, namely, a Clerk's Transcript on Appeal, relating to an appellate court case involving respondent Frank Dunleavy who was indicted for bookmaking but said indictment was dismissed. A typescript in green-gray paper wrappers fastened by two metal brads near the spine. 8" x 10." Fifteen pages, complete. Red "Copy" stamp at top of front cover. Pages are very clean and intact except for light age toning, occasional small annotations, slightly bumped corners, and two small closed tears along spine on last leaf not affecting text. Covers are clean and intact overall but have moderate age toning, a few wrinkles, slight wear to extremities, and two small closed tears along spine on back cover not affecting text. A Very Good copy. This document, a Clerk's Transcript on Appeal, relates to the appellate case, "The People of the State of California vs. Frank Dunleavy" in which the People of the State of California appealed the dismissal of Dunleavy's indictment for bookmaking. In this case, the People of the State of California were the appellants and Dunleavy was the respondent. Dunleavy was indicted for being a bookie managing horse-racing bets. The transcript describes how papers and other physical evidence of Dunleavy's bookmaking activities were found at 166 East Street in San Francisco. However, Dunleavy's indictment was eventually dismissed. The front cover names George H. Cabaniss as the judge. Harry E. Michaels was the attorney for Dunleavy. The attorneys for the People of the State of California were U. S. Webb, C. M. Fickert, and Jas. F. Brennan. Percy J. Hayselden is named as the Clerk. There is an Index in front which lists the contents as follows: "Arraignment of Defendant," "Application for the Transcription of Reporter's Notes," "Copy of the Indictment," "Clerk's Certificate to Indictment," "Clerk's Certificate to Judgment Roll," "Demurrer to Indictment," "Decision on Demurrer," "Judgment of Dismissal," "Names of Witnesses Examined Before Grand Jury," "Notice of Appeal," "Order Assigning Cause," "Order Directing Transcription of Reporter's Notes," "Presentation and Filing of Indictment," "Statement of Grounds of Appeal," "Title Page," and "Transcript on Appeal." The full title on front cover reads, "In the District Court of Appeal of the State of California, First Appellate District. The People of the State of California, Appellant vs. Frank Dunleavy, Respondent.
