Collection of three original documents relating to an appellate court case involving defendant Cornelius Manning ("Criminal No. 1156"), convicted of manslaughter. The documents are a Respondent's Brief (brown paper wrappers with staple binding, ten pages), Appellant's Opening Brief (green paper wrappers with staple binding, nineteen pages), and a Transcript on Appeal (blue paper wrappers, 214 pages). Each document: 7" x 10." Pages are very clean and intact except for light age toning and occasional small annotations. Covers are clean and intact overall but have age toning, a few creases, and slight wear to extremities. The Respondent's Brief has some rubberband residue on front. The Appellant's Brief and Transcript on Appeal have red "Sacramento Office Copy" stamps on front. Transcript also has a few annotations in black ink and pencil on front. Each document and the entire collection are Very Good. These three documents relate to the appellate case, "The People of the State of California vs. Cornelius Manning" in which Manning appealed his conviction and ten-year prison sentence in San Quentin State Prison for manslaughter. U. S. Webb (also listed as W. S. Webb?), J. C. Day, and Lewis F. Byington were the attorneys for the People of California. Nathan C. Coghlan and Robert Ferral were the attorneys for Manning. Frank C. Jordan is listed as the Clerk on the front of each document. The following is a description of the events leading up to the crime. Cornelius Manning was the son of Mrs. Bridget Manning, the latter of whom had invited guests over to her San Francisco apartment for dinner on July 4, 1899. Among the guests were a couple, Paul and Mary Kennedy; the Kennedys' adopted children; Leonora Manning, Cornelius's sister; and an older woman identified as Delia. Cornelius later joined the party. Another guest, John Tarleton arrived last. Everyone at the party had beer except for Leonora. Cornelius, who was likely inebriated at this point, and Tarleton got into a verbal altercation after which Tarleton left the apartment. However, events escalated when Paul Kennedy began to reprimand Cornelius for the way he was treating his mother. This led to the Kennedys restraining Cornelius on a sofa after which they released him and made to leave the apartment. In a drunken rage, Manning got up and threw a large coal oil lamp toward Mary Kennedy which struck her face. It is unclear if Mary was his intended target. After being struck by the lamp, Mary's face and upper torso caught fire. Tragically, she received substantial burns to her face and upper torso and died six days later. Doctors concluded that Mary died from her burns and "inhalation of flames" compounded by her pre-existing pneumonia. The jury from the original trial convicted Cornelius of manslaughter in 1901. The following are summaries of each document, numbered 1-3. 1) Respondent's Brief: contains the arguments made against Cornelius Manning which uphold his conviction. 2) Appellant's Opening Brief: contains arguments in favor of Cornelius's defense and appeal, one of which is that Cornelius had not intended to throw the lamp toward anyone and that he only threw it because it was too hot. 3)Transcript on Appeal: among its contents are "Arraignment on Charge," "Arraignment for Judgment," "Assignment of Cause," "Bill of Exceptions," "Charge of the Court," "Defendant's Proposed Instructions," "Exceptions," "Exhibits" [descriptions], "Information for Murder," "Information Read to Jury," "Minutes of the Court," "Minutes of the Plea," "Minutes of the Third Trial," "Motion for a New Trial," "Names of Jurors," "Notice of Appeal," "Verdict," and direct and cross-examinations of witnesses. Among the witnesses called to testify were Paul Kennedy, the doctors who treated Mary Kennedy or performed her autopsy, the police officers involved in the case, John Tarleton, Bridget Manning, Cornelius Manning, and Leonora Manning..
